LatSeller Privacy Policy

1. General provisions

This Privacy Policy explains how SIA LatSeller collects, uses, stores and protects the personal data of users of the LatSeller platform.

By using the LatSeller website, creating an account, posting listings, sending messages or using paid services, the user provides certain personal data necessary for the operation of the platform.

Personal data is processed in accordance with the European Union General Data Protection Regulation (GDPR), the laws of the Republic of Latvia and other applicable legal requirements.

No separate Data Protection Officer (DPO) has been appointed. All questions related to the processing of personal data may be sent to the email address indicated above.

3. What personal data we process

Depending on how LatSeller is used, we may process the following categories of data.

3.1. Account data

• name or display name;
• email address;
• telephone number, if provided;
• account type;
• interface language;
• profile data and other information voluntarily provided by the user;
• encrypted password and technical authentication data;
• registration date and account status.

LatSeller does not require an identity document to be uploaded for registration, posting a listing or ordinary use of the platform.

3.2. Listing data

• listing title and description;
• listing category;
• price and characteristics of the product, service, vacancy or other offer;
• location and address, if provided by the user;
• photographs;
• external links to YouTube videos;
• contact details selected by the user for publication;
• posting date, validity period and listing status;
• information about the selected listing plan.

The user determines the content of the listing and must not publish unnecessary personal data or information about other persons without a lawful basis.

3.3. Messages and enquiries

We may process:

• messages between users sent through the platform's functions;
• support enquiries;
• messages sent through contact forms;
• the sender's email address and other contact details;
• the content of correspondence;
• technical information necessary to deliver the message and prevent misuse.

3.4. Payment and transaction data

When paid services are used, the following may be processed:

• the selected paid plan;
• payment amount and currency;
• transaction identifier;
• payment purpose and unique payment Reference;
• payer's name, if included in the banking information;
• payment status;
• date the payment was created and confirmed;
• information about topping up or using the internal wallet, if the user uses this function;
• uploaded proof of bank transfer.

LatSeller does not request identity documents as part of payment. The user may upload a bank receipt or other proof of transfer for manual verification of the payment. Such a receipt may contain the payer's name, account number, amount, date, payment purpose and other information included by the bank or the user.

Users are advised to conceal information in the receipt that is not required to confirm the payment.

LatSeller does not receive online banking passwords, Smart-ID codes, banking authentication credentials or full payment card details.

3.5. Location data

If the user specifies a location in a profile, listing or search, we may process:

• country;
• region;
• city or locality;
• address;
• postal code;
• coordinates of the selected location;
• the search area selected by the user.

An exact location is not requested unless necessary. The user decides how precisely to specify an address in a listing.

3.6. Technical data and security logs

When the website is used, the following may be processed automatically:

• IP address;
• date and time of the request;
• address of the requested page;
• HTTP headers;
• browser type and version;
• device type and operating system;
• referral source;
• session identifier;
• error information;
• technical server logs;
• data necessary to prevent spam, fraud, attacks and other misuse.

Fields marked as mandatory are necessary to provide the relevant LatSeller function or service. If mandatory data is not provided, the relevant function or service may be unavailable. Other data is provided voluntarily.

4. Purposes and legal bases of processing

We process personal data for the following purposes.

4.1. Registration and account management

Purpose — to create an account, authenticate the user, manage the profile and provide personal account functions.

Legal basis — performance of a contract or steps taken at the user's request before entering into a contract.

4.2. Posting and displaying listings

Purpose — to create, publish, edit, promote and remove listings, display contact information and provide search functionality.

Legal basis — performance of a contract with the user.

4.3. Communication between users

Purpose — to transmit messages, notify the seller or another user and facilitate communication concerning a listing.

Legal basis — performance of a contract and the legitimate interests of LatSeller and its users in ensuring the safe operation of the marketplace.

4.4. Paid services and bank transfers

Purpose — to create a payment request, identify the payment, verify proof of bank transfer, activate a paid listing, maintain payment history and fulfil accounting obligations.

Legal basis:

• performance of a contract;
• compliance with legal obligations concerning accounting and taxation;
• the legitimate interest in preventing erroneous and fraudulent payments.

4.5. Service notifications

Purpose — to send notifications about registration, the account, listings, messages, payments, changes in service status, password recovery and other user actions.

Legal basis — performance of a contract and the legitimate interest in informing the user about the operation of the platform and the security of the user's account.

LatSeller does not currently use external CRM systems, marketing mailing services or manually sent marketing emails. The website sends standard service notifications necessary for the operation of the platform.

4.6. Security and prevention of misuse

Purpose — to protect the website and users, investigate violations and prevent fraud, spam, unauthorised access and other misuse.

Legal basis — the legitimate interests of SIA LatSeller and its users in ensuring the security of the platform, as well as compliance with legal obligations where applicable.

4.7. Compliance with law and protection of rights

Purpose — to comply with lawful requests from public authorities, resolve disputes, establish or defend legal claims and comply with regulatory obligations.

Legal basis — compliance with a legal obligation and the legitimate interest in protecting the rights of SIA LatSeller and third parties.

4.8. Optional external content

Google Maps and YouTube are used only after the user has consented to the relevant category of external content.

Legal basis — the user's consent.

The user may separately allow or prohibit Google Maps and YouTube and may change or withdraw the choice through the “Cookie settings” link in the website footer.

5. Public availability of information

Published listings may be available to an unlimited number of website visitors and may contain:

• listing title and description;
• photographs;
• price;
• characteristics;
• location;
• the user's name or display name;
• contact details that the user has chosen to publish;
• a link to a YouTube video.

The user must not publish data that is not required for the listing in the public section of the website, including documents, bank details, personal identification numbers, confidential correspondence or personal data of third parties without an appropriate lawful basis.

6. Recipients of personal data

Personal data may be accessible to the following categories of recipients:

• the hosting and server infrastructure provider;
• the email or SMTP infrastructure provider used to deliver service messages;
• an external accountant or accounting company to the extent necessary for accounting and tax records;
• technical contractors granted limited and temporary access for the development, maintenance, diagnosis or protection of the website;
• Google — only if the user has consented to loading Google Maps;
• YouTube/Google — only if the user has consented to loading YouTube videos;
• banks and other participants in a bank transfer to the extent necessary to execute the payment;
• public authorities, courts and law-enforcement institutions where disclosure is required by law.

Information about transactions, bank statements, the payer's name and proof of payment may be disclosed to an external accountant. Data that is not required for accounting or tax records is not disclosed to the accountant.

The owner or administrator of SIA LatSeller has permanent administrative access to accounts, messages, transactions and uploaded proofs of payment. Technical contractors may receive only temporary access to the extent necessary to perform specific work.

7. Google Maps and YouTube

7.1. Google Maps

Google Maps may be used to display the location of a listing and provide other mapping functions.

Before the user gives consent, external Google Maps content is not loaded and no requests are sent to Google Maps. Instead of a map, the website may display a notice inviting the user to permit it to load.

After consent, the user's browser may establish a direct connection to Google services. In that case, Google may receive the IP address, technical browser data, information about the page being visited and other data in accordance with its privacy rules.

7.2. YouTube

The user may add an external link to a YouTube video to a listing.

Before the user gives consent, the embedded video, preview image and other external YouTube resources are not loaded. Instead of the video, the website may display a notice inviting the user to permit it to load.

After consent, the user's browser may establish a direct connection to YouTube and Google. These services may receive the IP address, technical browser data, information about the page being visited and interaction with the video content.

Consent may be withdrawn or the choice changed through the “Cookie settings” link in the website footer.

8. Cookies and similar technologies

LatSeller uses necessary cookies to:

• create and maintain the user session;
• authenticate users;
• ensure security;
• store user-selected actions without which the requested function cannot operate.

Optional cookies and external services are used only in accordance with the user's choice.

The user may:

• allow external content;
• reject optional cookies;
• configure Google Maps and YouTube separately;
• allow or prohibit preference cookies;
• change or withdraw the choice through the “Cookie settings” link.

9. International data transfers

Primary data processing takes place in the European Union or European Economic Area, or is carried out by providers required to ensure an applicable level of data protection.

When Google Maps or YouTube is used, personal data may be processed by companies in the Google group, including outside the European Economic Area. Such processing begins only after the user gives consent.

If a recipient is located outside the European Economic Area, the transfer is carried out where a protection mechanism provided for by the GDPR is in place, such as a European Commission adequacy decision, Standard Contractual Clauses or another lawful basis.

10. Data retention periods

We retain personal data no longer than necessary for the purposes for which it is processed.

The following criteria apply:

• active account data is retained for the period during which the account is used;
• listings and related media are retained while a listing is active, remains in the personal account or is required for the operation of the platform;
• messages and enquiries are retained for the period necessary to provide the service, maintain security and resolve disputes;
• data concerning incomplete and completed transactions, bank receipts and accounting documents is retained for the periods prescribed by applicable accounting, tax and other laws;
• technical logs are retained for a reasonable period necessary for security, diagnosis and incident investigation;
• data required for handling claims or legal disputes may be retained until the applicable limitation period expires or proceedings are completed;
• the user's cookie choices are retained for the period specified for the relevant consent cookie or until the choice is changed or withdrawn.

At the user's request, account data, listings and related media are deleted or anonymised, except for information that must be retained to comply with accounting and tax obligations, resolve disputes, prevent fraud, establish or defend legal claims or meet legal requirements.

Backups may be retained for a limited period within the established backup cycle. Data in backups is not used for ordinary operations and is deleted when backups are routinely overwritten, unless longer retention is required for security or compliance with a legal obligation.

11. Minor users

LatSeller does not establish its own separate age threshold for registration. Minors may use the platform to the extent permitted by applicable law.

If the law requires the consent of a parent or legal representative for a particular processing of personal data, transaction or paid service, the minor must obtain that consent before taking the relevant action.

If the processing of a minor's data is based on consent and applicable law requires the consent of a parent or legal representative, LatSeller may request confirmation that such consent has been obtained or restrict the relevant function.

A parent or legal representative may contact info@latseller.com if they believe that a minor's data is being processed unlawfully.

12. Protection of personal data

SIA LatSeller applies reasonable technical and organisational measures to protect personal data against:

• unauthorised access;
• accidental loss;
• unlawful alteration;
• disclosure;
• destruction;
• other unlawful forms of processing.

Access to administrative functions and personal data is restricted to persons who require it to perform the relevant duties.

Despite the measures taken, no internet system can guarantee absolute security. The user is also responsible for keeping their password secure and protecting their own account.

13. User rights

In the cases provided for by law, the user has the right to:

• receive information about the processing of their personal data;
• request access to their personal data;
• request the rectification of inaccurate or incomplete data;
• request the erasure of data;
• request restriction of processing;
• object to processing based on legitimate interests;
• receive data they have provided in a structured, commonly used and machine-readable format where the right to data portability applies;
• withdraw consent at any time where processing is based on consent;
• lodge a complaint with a supervisory authority;
• not be subject to a decision based solely on automated processing that produces legal or similarly significant effects, where that right applies.

Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.

To exercise their rights, users may contact info@latseller.com. To protect data, we may request information necessary to verify the identity of the applicant, but we will not request more data than is necessary for that purpose.

14. Complaints to the supervisory authority

If a user believes that their personal data is being processed unlawfully, they may contact the Latvian supervisory authority:

15. User obligations

The user must provide accurate data and respect the rights of other persons.

By posting another person's data, the user confirms that there is a lawful basis for publishing it or transmitting it to LatSeller.

It is prohibited to publish the following in listings, messages or uploaded materials:

• another person's personal data without a lawful basis;
• identity documents;
• passwords and authentication codes;
• full bank details unless required for a lawful purpose;
• special categories of personal data without necessity and an appropriate lawful basis;
• information that violates confidentiality or the rights of third parties.

16. Changes to the Privacy Policy

SIA LatSeller may update this Privacy Policy when laws, website functions, data-processing methods or service providers change.

The current version is published on the LatSeller website with the date of the latest update. Users may be provided with an additional notice in the event of material changes.
