LatSeller Terms of Use

1. General provisions

These Terms of Use govern access to and use of the LatSeller platform.

The platform operator is:

By using LatSeller, creating an account, posting a listing, paying for a service or sending a message, the user accepts these Terms.

2. Purpose of the platform

LatSeller is an online classifieds platform that enables users to post, find and view offers for goods, services, real estate, jobs and other offers, and to communicate with one another.

LatSeller is not the seller or buyer of goods and services stated in user listings, is not a party to transactions between users and does not act on behalf of a seller or buyer unless expressly stated otherwise.

The user independently decides whether to enter into a transaction with another user, verifies information about the goods, service and counterparty, and is responsible for the terms of that transaction.

3. User account

Registration of an account is required to use certain LatSeller functions.

The user must:

provide accurate, current and complete information;
keep account information current;
keep login credentials confidential;
not transfer the account to third parties without LatSeller’s permission;
promptly inform LatSeller of suspected unauthorised account access.

The user is responsible for actions taken through the account unless they result from a security breach on the part of LatSeller.

4. Seller status: private individual or commercial seller

A user posting listings must indicate the status “Private individual” or “Commercial seller”.

A user must choose “Commercial seller” where listings are posted in the course of economic, professional or commercial activity. The user must choose the status honestly and change it if the nature of the activity changes.

This status is independent of the technical account type on the platform and does not itself restrict the ability to buy or post listings.

The seller status is displayed on the listing page.

Where a seller is identified as a private individual, consumer rights that may apply to a contract with a commercial seller may not apply to a transaction between two private individuals.

A commercial seller is independently responsible for compliance with applicable legal requirements, including consumer protection, mandatory-information, tax, advertising, product-safety and personal-data requirements.

5. Posting listings

A user may post listings only in suitable categories and in compliance with these Terms, platform rules and applicable law.

A listing must contain accurate, clear and non-misleading information. The user must state correct characteristics, price, condition, material terms and other information needed for another user to make an informed decision.

The user must not repost the same listing or create an artificial appearance of demand, supply or activity.

LatSeller may set technical requirements for listings, including requirements concerning category, photographs, description, publication period and the selected plan.

6. Prohibited listings and conduct

It is prohibited to post, offer, transfer or distribute through LatSeller:

illegal goods, services or activities;
goods whose circulation is prohibited or restricted without required permits;
fraudulent, fictitious or misleading offers;
counterfeit goods and material infringing intellectual-property rights;
material containing threats, incitement to hatred, discrimination, violence or other illegal content;
personal data of third parties without a lawful basis;
spam, mass advertising, malicious links, phishing material or other abuse;
offers violating consumer rights, advertising rules, safety requirements or other applicable rules.

It is prohibited to use LatSeller to circumvent platform restrictions, collect data automatically without permission, create fictitious accounts, manipulate statistics or otherwise interfere with the platform or other persons’ rights.

7. Photographs, video and other user content

The user is responsible for material posted on LatSeller, including text, photographs, video, YouTube links, trade marks and other material.

By posting content, the user confirms having the rights, permissions and lawful basis necessary for publication.

The user grants LatSeller a non-exclusive, royalty-free right to use posted content to the extent necessary for platform operation, displaying the listing, technical processing, moderation and promotion of that listing on LatSeller.

LatSeller does not acquire ownership of user content.

8. Transactions between users

All negotiations, arrangements, transfer of goods, provision of services, payment and performance of obligations in transactions between users are carried out independently by those users.

LatSeller does not guarantee:

availability of goods or services;
accuracy of information stated by a user;
quality, safety, legality or conformity of goods with their description;
the solvency, good faith or identity of another user;
performance of a transaction by the other party.

The user must exercise reasonable care in transactions and must not give third parties passwords, confirmation codes or other means of access to banking or other accounts.

9. Messages between users

LatSeller may provide an internal messaging function for communication about listings.

The user must not use messages for spam, fraud, threats, distribution of illegal content, collection of data without a lawful basis or other violations.

LatSeller may restrict messaging where there are signs of abuse, violation of law or these Terms.

10. Moderation and notices of violations

A user may report a suspected violation connected with a listing through the “Report listing” function on the listing page.

Notices of suspected illegal content or rule violations are reviewed with the involvement of an administrator. Submitting a report does not itself result in automatic removal of a listing or blocking of a user.

If the reporting person has provided electronic contact details, LatSeller confirms receipt without undue delay. After taking a decision concerning the content identified in the notice, LatSeller informs the reporting person of that decision and, where applicable, of available means of appeal or other legal redress.

LatSeller may request additional information where necessary to assess the notice. Reporter data are not disclosed to the listing owner without a lawful basis.

11. Free and paid services

LatSeller may provide free and paid services, including listing publication and other functions available on the platform.

Before ordering a paid service, the user is provided with information about the selected service, its price, period, material conditions and the applicable right of withdrawal.

The price, currency, period and other conditions of a specific service are determined by the information shown to the user before order confirmation.

12. Conclusion of contract and start of paid service

A user’s order for a paid service is an offer to conclude a contract.

A contract for a paid service is concluded when LatSeller accepts the order. Acceptance is confirmed by information provided during the ordering process and by order confirmation supplied to the user on a durable medium.

The confirmation contains information about the ordered service, price, period, order date and the consumer’s right of withdrawal.

If the user asks for performance to begin before the end of the applicable 14-day withdrawal period, the user must separately and expressly confirm that request and acknowledge the consequences of full performance for the right of withdrawal.

If the user does not ask for service to start before the withdrawal period ends, the start of service is deferred until the end of the applicable withdrawal period unless another procedure is permitted by law.

A bank transfer is deemed received after it has actually arrived and been confirmed by LatSeller. Where payment is made with Credits, the service may be paid for in accordance with the conditions shown before confirmation of the operation.

13. Consumer right of withdrawal and refunds

Where the user is a consumer and a right of withdrawal from a distance contract applies to the ordered paid service, the consumer may withdraw from the contract within 14 days from its conclusion without giving a reason.

The consumer may submit a declaration through the “Withdraw from contract” function available on LatSeller. In the declaration, the user confirms their name, the specific order and email address for receiving confirmation.

After submission, the user receives confirmation of receipt on a durable medium containing the declaration, and the date and time of its receipt.

If the consumer expressly asked for performance to begin before the 14-day withdrawal period ended and then exercises the right of withdrawal, the consumer must pay an amount proportionate to the part of the service actually provided until the withdrawal declaration is sent.

The right of withdrawal may end after full performance only where the conditions provided by law are met, including the consumer’s prior express consent to begin performance and acknowledgement of the consequences for the right of withdrawal.

If a refund is due, LatSeller makes it without undue delay and no later than 14 days after receipt of the withdrawal declaration, less any amount payable by law for the part of the service actually provided. The refund is made using the same payment method unless the consumer expressly agrees otherwise and incurs no additional cost.

Refunds are reviewed manually in view of the specific order, payment method and extent of service actually provided.

14. Credits

Credits may be used by a user to pay for available LatSeller services in accordance with the number of Credits and conditions shown before confirmation of the operation.

Use of Credits does not limit mandatory consumer rights under applicable law.

15. Ranking and listing visibility

LatSeller listings are normally ordered primarily by publication date, with newer listings displayed higher.

On the homepage, newer active listings are shown first in the “Recently Added” block.

In categories and search, Featured status technically has priority over ordinary listings. The user’s chosen sorting is then applied; by default, newer listings are shown first.

The search query and filters determine which listings match the user’s request. Geographic filters may limit results and, in relevant modes, take account of location and distance.

As of the date of this version, active paid LatSeller plans do not provide Featured status, pinning, bumping, highlighting or any other paid ranking priority.

If LatSeller introduces a paid function affecting ranking or listing visibility in the future, its effect will be disclosed to the user before purchase.

16. Restriction, removal and blocking

LatSeller may hide, remove or restrict a listing, restrict an individual function, or suspend or terminate account access where there are reasonable grounds to believe that the user:

has violated law, these Terms or third-party rights;
has posted a prohibited or misleading listing;
is engaging in fraud, spam or other abuse;
creates a risk to the security of the platform, users or third parties.

Where required by applicable law and where it does not interfere with preventing harm or fraud or meeting a legal obligation, LatSeller informs the user of the grounds for the measure.

A commercial user may contact info@latseller.com concerning restriction, suspension or termination of platform use.

17. Access to commercial-user data

LatSeller has access to data that a commercial user provides to the platform and data generated through use of the platform to the extent necessary to provide services, ensure security, conduct moderation, process payments, maintain accounts and comply with legal requirements.

A commercial user has access through the account to their data and to data available through LatSeller functions, including the user’s own profile, listings and other information available to that user.

A commercial user does not receive access to non-public data of other users or aggregate data of other commercial users unless that possibility is expressly provided by a platform function or by law.

Data are transferred to service providers and other third parties only in the cases and for the purposes described in the LatSeller Privacy Policy or required by law.

After termination of an account, user access to data through the interface ends. Further retention is governed by the LatSeller Privacy Policy and applicable law.

18. LatSeller intellectual property

The LatSeller name, logo, website design, software, databases, text, interface elements and other platform material belong to SIA LatSeller, its licensors or are used lawfully.

The user may not copy, distribute, modify, decompile, extract data from or use LatSeller elements beyond ordinary use of the platform without prior written permission of the rights holder, unless permitted by law.

19. Termination of use and account deletion

The user may stop using LatSeller and delete the account through functions available on the platform.

Account deletion does not release the user from obligations incurred before deletion, including obligations to pay for services already ordered, resolve disputes and respect third-party rights.

Information may be retained after account deletion to the extent and for the period necessary to comply with law, accounting and tax obligations, resolve disputes, prevent fraud or protect the rights of LatSeller and other persons.

20. Minors

LatSeller does not set a separate age threshold different from the requirements of applicable law.

A minor user must obtain consent from a parent or legal representative where such consent is required by law to conclude a contract, use a paid service or take another action on the platform.

21. Liability, amendments and applicable law

LatSeller provides the platform as available at the relevant time, subject to mandatory legal requirements.

Nothing in these Terms excludes or limits consumer rights or LatSeller liability to the extent such exclusion or limitation is prohibited by applicable law.

LatSeller may amend these Terms due to changes in law, platform functions, methods of providing services, security requirements or other justified reasons. The current version is published on the website with its update date.

Where Regulation (EU) 2019/1150 applies to the relationship with a commercial user, LatSeller notifies that user of proposed amendments to the Terms on a durable medium at least 15 days before they take effect. A longer period applies where necessary for the user’s technical or commercial adaptation. Exceptions to the notice period apply only where provided by law.

A commercial user may terminate the contractual relationship with LatSeller before expiry of the applicable notice period in the cases and manner provided by Regulation (EU) 2019/1150.

These Terms are governed by the law of the Republic of Latvia and applicable European Union law. Consumer disputes are resolved subject to mandatory consumer-protection and jurisdiction rules applicable to the consumer.
